What began as a delayed flight turned into a heated confrontation at 30,000 feet — and now a veteran flight attendant is fighting to get his job back.

Alan O’Neill, a senior cabin crew member with Irish airline Aer Lingus, was reportedly terminated after a dispute with a passenger who repeatedly tried to use the restroom during delays and while the seatbelt sign was on. The incident happened April 9, 2024, aboard Flight EI-515 from Marseille to Dublin.

O’Neill has since filed a complaint under Ireland’s Unfair Dismissals Act, and the case is now being heard before a Workplace Relations Commission tribunal.

A Tense Delay on the Tarmac

According to testimony reported by Irish media, the flight was delayed due to an issue with the aircraft’s auxiliary power unit. Passengers were allegedly left waiting in a part of the terminal with no accessible bathrooms before boarding.

Once onboard, the aircraft remained on the tarmac, and lavatories were reportedly unavailable during refueling.

Another flight attendant, Claire Durkan, testified that a male passenger in his 30s became frustrated after O’Neill denied him access to the restroom. The passenger allegedly muttered “oh for f—’s sake” under his breath after being refused.

Durkan also testified there was a window of time during refueling when the passenger could have used the bathroom, but she claimed he was not informed of that opportunity.

Clash in the Cabin

After takeoff, while the fasten seatbelt sign was illuminated, the passenger reportedly stood up again to try to use the restroom. O’Neill allegedly told him to sit down, saying, “You can’t go to the toilet. I’ll tell you whenever you can go to the toilet.”

O’Neill’s account differs. He testified that the passenger attempted to push past him during boarding while fueling was underway and had already received two verbal warnings. As a result, he was issued a “Dip 1 form,” a written warning for disruptive behavior.

Tensions escalated further when the crew requested the passenger’s boarding pass to complete the report. The passenger allegedly refused to hand it over unless he was allowed to use the restroom.

According to testimony, O’Neill told a colleague the passenger would not be permitted to use the toilet unless he produced the boarding pass.

Witnesses gave varying accounts of how long the standoff lasted once the plane was in the air. At one point, O’Neill claimed the passenger told him, “F— you, I need to use the toilet.”

When the man was finally allowed to go, witnesses agreed he was visibly upset and left in tears.

Accusations of Aggression

Senior Aer Lingus manager Mary McHugh testified that O’Neill was accused of being aggressive, angry, and extremely unprofessional during the incident. She alleged he engaged in threatening behavior and appeared to have “snapped.”

When questioned about his actions, McHugh said O’Neill explained that he felt fearful and triggered by the passenger’s behavior.

Despite 12 years of service and what was described as a previously clean disciplinary record, O’Neill was terminated. He is now challenging that decision, arguing he was unfairly dismissed.

The tribunal hearing has been adjourned until May, and the case remains ongoing.
