Kevin Costner is facing serious accusations from a stunt performer who claims she was subjected to an unscripted and violent rape scene during filming of Horizon: An American Saga – Chapter 2.

Devyn LaBella, whose previous work includes Barbie and American Horror Story, filed a lawsuit Tuesday accusing Costner and the film’s producers of sexual harassment, discrimination, and retaliation. The shocking allegation? That Costner directed an unexpected, non-consensual scene on May 2, 2023, that left her emotionally traumatized.

According to court documents obtained by TMZ, LaBella says she had already filmed a pre-approved sexual assault scene the day before, which was planned and included an intimacy coordinator. But when she arrived on set the next day, she was allegedly blindsided by a second scene—one she claims was not in the script and had no safety coordinator on set.

LaBella claims Costner, who both stars in and directs the Western epic, gave actor Roger Ivens specific instructions that led to her being violently pinned down and physically restrained during the take. She says she felt powerless and violated, describing the experience as “unscheduled and unscripted.”

The lawsuit also alleges that after LaBella reported the incident to the stunt team and intimacy coordinator, she was quietly blacklisted from future opportunities on Horizon and with related production crews.

In the months that followed, LaBella says she began therapy to cope with flashbacks, anxiety, fear of intimacy, and emotional distress. She claims the scene left her feeling “worthless” and like a “disposable” piece of the production.

LaBella is seeking general and compensatory damages and claims Costner and the film’s producers acted with “malice, fraud, oppression, and in reckless disregard” for her safety and rights.

Costner’s attorney, Marty Singer, has fired back, calling the lawsuit “absolutely no merit” and asserting that Costner takes set safety very seriously. Singer also noted that LaBella later treated the stunt coordinator to dinner as a thank-you gesture and texted him, saying, “Thank you for these wonderful weeks!”

The case is still developing, but it’s clear the fallout could cast a long shadow over Costner’s ambitious Western saga.
